Ravindra Waikar should not be sworn in as MP; Notice to Secretary General of Lok Sabha

From Mumbai North West Lok Sabha constituency, Shiv Sena's candidate Ravindra Waikar defeated Shiv Sena Thackeray faction's Amol Kirtikar by just 48 votes. After this, accusations were exchanged between the ruling party and the opposition. Doubts were raised by the Thackeray group on this victory of Vaikars. Votes have not been counted here in a transparent and legal environment. Therefore, Hindu Samaj Party candidate Bharat Shah, who contested the Lok Sabha elections from Mumbai North West Constituency, has sent a notice to Lok Sabha Secretary General Utpal Kumar Singh demanding that he should not be sworn in as an MP in the Lok Sabha.

The notice sent states that it is the first time in India that an FIR has been filed regarding EVM machine vote counting. Therefore, according to Article 99, Ravindra Vaikar has said that giving him the oath of office as a Member of Parliament would mean giving permission to desecrate the constitutional process. It has been mentioned in the notice that no one has made such a demand before. However, keeping in mind the purpose of the constitution for taking the oath, as a positive action, Rabindra Waikar should not be sworn in as an MP, the notice said. An FIR has been filed by the police after it was alleged that a relative of a candidate was present at the counting place with a mobile phone which was linked to the EVM machine and investigations are on.

This is the first time that an FIR has been filed in this regard, while it is often discussed that the process of voting and counting of votes through EVMs will be decided and misused in some selected constituencies, some government officials will be held in hand and arrangements will be made for the BJP to get a favorable result. Therefore, it has been said in this notice that Ravindra Waikar, whose election is doubtful at first glance, should not be sworn in as an MP. In Mumbai North-West Constituency, the CCTV footage of Nesco Center is being deliberately avoided. Bharat Khimji Shah pointed out that this fact shows that the government machinery is helping Ravindra Waikar under the pressure of Chief Minister Eknath Shinde and the central government to hide the truth.
